PAWNEE COUNTY BOARD OF COMMISSIONERS
July 28, 2009
The Pawnee County Board of Commissioners met in regular session, which was open to the public, on
Tuesday, July 28, 2009 at 9:00 a.m. in the Courthouse meeting room. Notice of such meeting was
published in the Thursday, July 2, 2009 issue of The Pawnee Republican. Present were Kay Laun, Rasty
Stephens, Wayne Cacek and Carol Young, County Clerk. Chairman Laun announced the open meeting
law poster is posted on the east wall of the meeting room. Cacek made a motion to approve the
minutes of July 14, 2009. Seconded by Stephens. Voting aye: Stephens, Cacek, Laun. Stephens moved
to approve the Board of Equalization minutes of July 14,15 and 23, 2009. Cacek seconded the motion.
Voting aye: Cacek, Laun and Stephens. Cacek moved to approve the agenda as presented. Seconded
by Stephens. Voting aye: Cacek, Laun and Stephens. Cacek made a motion to approve the claims as
presented. Stephens seconded the motion. Voting aye: Laun, Stephens and Cacek.
Mike Wilcox, Emergency Manager, met with the Board. They discussed the trailer that was used at the
fair, the generator that has been set up at the east communications tower and the 27 handheld radios
that had been bought with the last of the grant funds.
Cheryl Dahlgren, County Treasurer, Jonathan Bailey, County Assessor, and Victor Faesser, County
Attorney, met with the Board regarding delinquent personal property taxes for Galaxy American
Communications. Stephens moved to direct the County Attorney to start foreclosure procedure on
TSS792006, parcel #10080005. Cacek seconded the motion. Voting aye: Stephens, Cacek and Laun.
Cacek moved to direct the County Treasurer to put any delinquent taxes on tax sale certificates.
Stephens seconded the motion. Voting aye: Cacek, Laun and Stephens.
The Board reviewed SENCA correspondence. Cacek & Laun signed up for the Southeast District meeting
to be held September 28"' at Mahoney State Park. The Board reviewed the SENDD correspondence.
The Board discussed the law enforcement contracts with the Villages. Stephens moved to enter into a
law enforcement agreement with the Village of Table Rock, DuBois, Burchard, Steinauer and Lewiston.
Cacek seconded the motion. Voting aye: Laun, Stephens and Cacek.
Bob Miller, Manager of Operations, and Byford Schmit, Courthouse Janitor, met with the Board
regarding the membrane on the ledge around the top of the Courthouse that has come loose and is
allowing moisture to get in behind and under it. Stephens moved to sign an agreement to have the
repair work done on the ledge of the Courthouse. Cacek seconded the motion. Voting aye: Laun,
Stephens and Cacek. Schmit left the meeting. Miller presented the rock reports and project lists. He
then discussed Local Public Agency Responsible Charge. In order to get Federal funds, each County has
to have and LPARC which requires two weeks of schooling. Miller is signed up and Laun requested to be
signed up. If two people went, a backup person would be in place. Cacek moved to authorize Mainelli,
Wagner and Associates to prepare the bids for the box culvert by Larry Bstandig's. Stephens seconded
the motion. Voting aye: Laun, Stephens and Cacek. Stephens moved to appoint Bob Miller with a Class
B license as the Highway Superintendent effective July 28, 2009. Cacek seconded the motion. Voting
aye: Stephens, Cacek and Laun.
Johnson County Commissioners met with the Pawnee County Commissioners to discuss the dispatch
contract. Jim Kubik, Brandon Willey, Sheriff Reed & Tina Moore were present. They discussed both the
dispatch contract and the "911" dispatch contract. Tina Moore reported a problem with the "911"
dispatch this past weekend, Brandon Willey discussed various incidents from the past couple of months.
Mr. Willey said that the problems seem to depend on who is dispatching. Johnson County
Commissioners and Pawnee County Commissioners discussed the lack of an Emergency Manager in
Johnson County. Pawnee County will discuss the issues with Mike Wilcox.
