PAWNEE COUNTY BOARD OF COMMISSIONERS AUGUST 1, 2017

The Pawnee County Board of Commissioners met in regular session, which was open to the public, on Tuesday, August 1, 2017 at 9:00 a.m. in the Courthouse meeting room.  Notice of such meeting was published in the Thursday, July 20, 2017 issue of The Pawnee Republican.  Present were Commissioners Dennis Schaardt, Jan Lang, Ron Seitz and County Clerk Candi Nicholas.  Chairman Schaardt announced the open meeting laws poster was posted on the east wall. Lang moved and Seitz seconded to approve the minutes of July 18, 2017. Voting: Lang (yes) & Seitz (yes), Schaardt (Abstain). Lang moved and Seitz seconded to approve the agenda as presented. Voting: Lang (yes), Seitz (yes) and Schaardt (yes). Seitz moved and Lang seconded to approve the claims as presented. Voting: Seitz (yes), Schaardt (yes) and Lang (yes).

 

The Board reviewed the Pawnee County Agriculture Society audit waiver. After reviewing Seitz moved and Lang seconded to sign the Subgrant Agreement for the Child Support Enforcement Services for the County Attorney between Pawnee County and NE Department of Health & Human Services Child Support Enforcement Program. Voting: Schaardt (yes), Lang (yes) and Seitz (yes). After reviewing Lang moved and Seitz seconded to approve the Subgrant Agreement for Child Support Enforcement Services for the Clerk of the District Court between Pawnee County and NE Department of Health & Human Services Child Support Enforcement Program. Voting: Lang (yes), Seitz (yes) and Schaardt (yes).

 

The Board discussed the Handibus Interlocal Agreement between Pawnee County and the City of Pawnee City. Lang moved and Seitz seconded to keep the Interlocal Agreement the same as last year with the City of Pawnee City paying Pawnee County $3200.00 for the operation of the Pawnee County Handi-Bus for the period of July 1, 2017 through June 30, 2018. Voting: Seitz (yes), Schaardt (yes) and Lang (yes).

 

After discussion Lang moved and Seitz seconded to approve increasing the 2017-2018 law enforcement agreement between Pawnee County and the Villages of Burchard, DuBois, Lewiston, Steinauer & Table Rock to $11.80 per capita. Voting: Schaardt (yes), Lang (yes) and Seitz (yes). This changes the Village of Burchard to $967.60, Village of DuBois to $1,734.60, Village of Lewiston to $802.40, the Village of Steinauer to $885.00 and the Village of Table Rock to $3,174.20.

 

Jennifer Stehlik Ladman, County Attorney, met with the Board and discussed several items. The first being the Interlocal Agreement for the Funding of the District Court Bailiff. No action was taken due to the Judicial Ethics Opinion. Also discussed was correspondence from the Law Office of Cynthia R. Lamm regarding a tort claim against the County. The Board took no action due to the claim not being in Pawnee County jurisdiction. Also discussed setting up a drug enforcement petty cash account. No action was taken and Stehlik Ladman will discuss the petty cash account with the Pawnee County Drug Enforcement Board and provide a resolution at the August 15, 2017, Commissioner meeting. Also discussed an Equal Opportunity Commission (EOC) complaint sent to Pawnee County regarding a former employee of Pawnee County Memorial Hospital. Seitz moved and Lang seconded to decline to


participate in alternative dispute resolution regarding the EOC complaint. Voting Lang (yes), Seitz (yes) and Schaardt (yes).  Stehlik Ladman will respond to the EOC on behalf of the County regarding the complaint.

 

The Board reviewed the pending County Attorney Criminal & Juvenile Cases as of June 30, 2017 and the Cases Closed in 2017 reports.

 

The Board discussed the 2020 U.S. Census Bureau correspondence regarding Local Update of Census Addresses (LUCA) request for a representative of the County.  Jonathan Bailey, Assessor, will review the material and address the issue at the next Commissioner meeting on August 15, 2017.

 

Chris Rauner, Hwy Supt, Heather Duryea, Admin. Asst, met with the Board. Heather gave the rock report. Chris discussed changing a public hearing set for August 1, 2017 regarding the closure of a portion of 709 Road to August 29, 2017 at 10:30 a.m. After discussion Lang moved and Seitz seconded to approve Resolution 17-19 to replace Resolution 17-16 and set the public hearing to close a portion of 709 Road for August 29, 2017 at 10:30 a.m. Voting: Lang (yes), Seitz (yes) and Schaardt (yes).

 

The Board reviewed the belly dump trailer bids opened on July 18, 2017. After discussion Seitz moved and Lang seconded to accept the low bid of Siouxland Trailer Sales in the amount of $32,321.00 with a trade-in. Voting: Schaardt (yes), Lang (yes) and Seitz (yes).

 

Chris and the Board discussed the total eclipse on August 21, 2017. The Board doesn’t want any equipment on the roads the day of the eclipse. After discussion Lang moved and Seitz seconded to give all County employees four and one-half hours of paid time off. Voting: Lang (yes), Schaardt (yes) and Seitz (yes).

 

There will be a Hazardous Waste pickup site from 10:30 a.m. to 12:30 p.m. on August 25, 2017 at the County Shop being sponsored in part by Five Rivers RC&D.

 

Phillip Schneider, RDO Truck Center, discussed the tractor proposal with the Board. After discussion Seitz moved and Lang seconded to purchase a 2018 CHU613 T Mack Tractor with a trade of the Sterling for $94,063.00 using the state bid. Voting: Seitz (yes), Schaardt (yes) and Lang (yes).
